It is agreed this Letter of Understanding is further to Article 9.28 subsection [d] (formerly Casual Employee Letter of Understanding No. 13 subsection [d]).
Signed this 2nd day of May, 2007 on behalf of:
- Casual employees may state to the Company their daily availability by completing a three-part availability form with one [1] part to be retained by the employee, one [1] part to be given to the Plant Committee, and one [1] part to be submitted to the Manager of the department for approval.
- Availability will be stated in terms of days. Employees who do not submit an availability form will be assumed to have unrestricted availability.
- Employees may change their availability, by submitting a new availability form, a maximum of six [6] times per calendar year. However, a change in availability resulting in an increase in available hours will not count towards the six [6] time maximum.
- One [1] week notice to change availability for work is required.
- Notwithstanding [c], in the event there is a significant change to the schedule implemented by the Company, employees will be provided with the opportunity to adjust their availability without it counting towards the six [6] time maximum.
- All casual employees must meet a minimum availability of two (2) days per week, which must be any of Monday, Friday or Saturday.
It is understood that for the purpose of any Article in the Collective Agreement, an "unrestricted casual" shall be defined as:
- A casual employee with no restrictions of their availability; or
- A casual employee who meets the minimum availability as per this L.O.U. and who is available for an afternoon or graveyard shift for all other days within the week, provided their seniority allows them to be regularly scheduled to that shift. It is understood that employees may have to change their availability on a seasonal basis to ensure their seniority allows them to be regularly scheduled.
- Employees will be scheduled according to their availability. An employee will not be scheduled for voluntary overtime on a day that is not in accordance with his current availability.
- It is understood that an employee who limits his availability might receive fewer hours than an employee with full availability by reason of that limitation on his availability.
- Requests for single days-off, in addition to an employees availability, may be submitted, however, it is understood that these requests will be reviewed subject to operational and manpower requirements, and in view of the employees' prior day off requests and availability. Approval will not be unreasonably withheld.
