LETTER OF UNDERSTANDING NO. 13
WHISTLER ROUTE DELIVERY OPERATION
  1. DELIVERY OPERATION
    Effective October 5, 1998, the Whistler route shall be run five [5] days per week with one [1] truck per day, with the exception of peak periods or additional loads as defined below, and without a Swamper.

  2. DRIVER WAGES AND HOURS OF WORK
    There shall be a pool of eight (8) Class 1 drivers. These drivers shall be assigned to Whistler routes in accordance with their seniority. In the event a driver's seniority makes them eligible for a Whistler route they will be required to complete that route however, they may apply their seniority for preference of a Whistler route on that day.

    To apply for the driver pool above, employees must commit to the Whistler pool for a minimum of twelve (12) months.

    The workweek shall be three [3] days per week for the two [2] Posted Whistler positions.

    For those weeks that the Driver is assigned two [2] shifts on the Whistler route, the third shift shall be twelve [12] hours at straight time hourly rate and assigned as per the employee's seniority. For these Drivers the third shift of twelve [12] hours, overtime will be paid at the overtime rate after twelve [12] hours of work at straight time. Overtime provisions of the Collective Agreement shall not apply. Any employee replacements (i.e., vacation or sick relief) shall be made with the Posted Whistler Relief drivers in order of their seniority and secondly by employees that are trained and qualified to do the work.

    The Driver shall be paid at a fixed rate equivalent to his base rate multiplied by thirteen [13.0] hours for each daily run. Overtime provisions shall not apply.

  3. LUMPER WAGES AND HOURS OF WORK
    It is agreed that the Company will establish the position of Lumper located in Whistler.

    The intent of establishing this position is to assist the Driver in deliveries with regard to safety, customer service and operational efficiency.

    The Lumper hourly rate will be that of a casual employee and will be paid on a fixed number of hours, based on the farthest delivery point, as follows:
      Squamish    -   7 hours
      Whistler    -   8 hours
      Pemberton   -   9 hours
    
    The work schedule will be decided by the Company with regard for customer service, operational feasibility and operational effectiveness as identified by the drivers. Should the hourly requirement change, the Company and the Union shall meet to determine the appropriate requirement. Overtime provisions shall not apply.

  4. ADDITIONAL LOADS
    Should it be operationally required to perform additional runs, those runs shall be performed by Posted Whistler Relief drivers in order of their seniority, provided the run is cost effective, operationally practical, existing Company vehicles and regular employees are available and it is suitable to our customers. The fixed rate fee shall apply.

    For these purposes only, cost effective shall be defined as 75% of a full load or greater.

  5. PEAK PERIODS
    Four [4] months of each year will be defined as peak months. Peak months shall be the highest four [4] months of delivery volume. During the peak months there will be one [1] additional load per week. The day of the week will be determined by the Company with regard for customer service and operation feasibility.

  6. GENERAL
    It is understood that any outstanding operational and/or administrative issues shall be discussed seeking joint resolve with consideration for cost effectiveness, customer service and operational feasibility.

    It is understood that the Company, Union and employees will continue to discuss and participate in joint-problem solving and will have access to applicable financial statements.
