LETTER OF UNDERSTANDING NO. 2
ONE MAN DELIVERIES
  1. Implementation:
    1. On an as required basis, the City Delivery Manager and Chairman of the local Plant Committee (or their respective designates) shall meet to review current deliveries to determine whether one [1] man or two [2] men are required. This review shall be conducted using the process set out below.


  2. Review Process:
    1. The following process will serve as the basis for discussing whether deliveries require one [1] man or two [2] men:

      Step 1:
      The City Delivery Manager and the Chairman of the local Plant Committee (or their respective designates) shall meet, at the request of either party, to determine whether deliveries require one [1] man or two [2] men. Should they fail to agree, the matter shall be referred to Step 2.

      Step 2:
      In the event the parties cannot agree under Step 1, a Committee consisting of the following shall, after an on-site inspection, make a binding recommendation to settle the matter:

      1. The local Plant Committee Chairman or designate), and
      2. The City Delivery Manager


    2. Decisions of the review committee shall not be subject to the grievance and arbitration procedures under the collective Agreement.

    3. In the event an agreement cannot be reached, the parties shall select a mutually agreeable third party to make a binding decision on the matter. The cost of this third party will be shared equally between the Company and the Union.

    4. The outcome of the review process will not be affected by the utilization of licensee personnel who will not be assigned to assist in handling the product.

  3. New Accounts, And/Or Significantly Modified Accounts:
    1. New accounts, and/or existing accounts which are significantly modified, shall be reviewed using the above process.

    2. In the event that operational requirements do not permit a new account to be reviewed under this Letter prior to the initial delivery, the Company will assign two [2] men unless the Chairman of the local Plant Committee agrees that the account should be delivered by one [1] man, which agreement shall not be unreasonably denied.

    3. It is understood that the initial assignment of manpower under Sub-section [b] shall be on a without prejudice basis to the formal review of the account under this Letter.

  4. Agreed Upon Lists
    A listing of deliveries agreed upon under this letter shall be posted on the bulletin boards.
